A frequently relied upon defense in insurance defense cases such as product liability and toxic tort cases in Indiana has been the statute of repose. Plaintiffs had two years from the date they knew or should have known they suffered harm to file a lawsuit based upon the state’s statute of limitations. The statute of repose placed a 10-year limit on how long a plaintiff had to actually discover the harm before the claim would be barred. Drafting and maintaining a “Bring Your Own Device” (BYOD) policy is now a necessary component of any company’s privacy program. Advances in technology have provided employees the opportunity to use their own devices for work-related purposes. Now, a parent can use his/her personal laptop to remotely access a company computer while taking care of a sick child, or an employee can use an iPhone to reply to an e-mail while singing “Take Me Out to the Ballgame” at Wrigley Field. The use of employee-owned devices is a regular occurrence in most industries.

Transgender bathroom rights have been in the spotlight this year. The nation’s schools have been grappling with the issue of which locker rooms should transgender students be allowed to use. Businesses have also been drawn into the issue as they try to avoid gender discrimination in the workplace. Target stores recently made a public statement that it was allowing people to use the bathroom that corresponds with their gender identity. While some businesses are following the Target lead on this issue, other businesses are hesitant to take a public stance.
